Agreeing to these terms

These terms are an agreement between you and Lone Star Data Ranch (“we”, “us”), which runs AshBid at ashbid.com. By using AshBid or creating an account you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the site.

You must be 21 or older

AshBid is about cigars and other tobacco products. You may only use it if you are at least 21 years old and allowed to buy tobacco where you live. By using AshBid you confirm that you are.

What AshBid is (and isn’t)

AshBid records the public results of CigarBid auctions and shows price history, averages and deal ratings so you can decide what to bid.

• We are not affiliated with CigarBid.com or its owners, and they don’t endorse us. CigarBid and other names are trademarks of their owners and are used only to describe what we track.
• We don’t sell cigars, run auctions or place bids. Every purchase happens on CigarBid (or another retailer) under that site’s own terms, and any dispute about an order is between you and that seller.
• The FreeFall Tracker bookmarklet runs in your own browser on CigarBid’s pages. You choose whether and how to use it, including any automatic buying, and you are responsible for the purchases it makes and for following CigarBid’s rules.

Prices are estimates

Our data is gathered automatically and can be incomplete, delayed, matched to the wrong product or simply wrong. Averages, ranges, deal ratings and bid suggestions are for information only, not financial or purchasing advice. Always check the lot, its current price, shipping and taxes on CigarBid before you bid. We aren’t responsible for a bid, purchase or missed deal based on information from AshBid.

Your account

• Give us accurate information, including an email address you can receive mail at.
• Keep your password private. You’re responsible for what happens under your account; tell us at once if you think someone else is using it.
• One account per person. Accounts can’t be shared, sold or transferred.
• We may suspend or close an account that breaks these terms or puts AshBid or other people at risk.

AshBid Pro & billing

• Payments. AshBid Pro is a paid subscription, billed through Stripe. By subscribing you authorize recurring charges to your payment method.
• Renewal. Monthly plans renew every month and yearly plans every year, at the price shown when you subscribed, until you cancel. Prices don’t include any taxes that apply.
• Cancelling. You can cancel any time from your account page (Manage billing). You keep Pro until the end of the period you’ve paid for, and you won’t be charged again.
• Refunds. Payments aren’t refundable for partly used periods, except where the law requires it. If you were charged by mistake, email [email protected] within 30 days and we’ll put it right.
• Price changes. We’ll tell you by email at least 14 days before a new price applies to your subscription, so you can cancel first if you prefer.
• Failed payments. If a renewal can’t be charged, Stripe will retry for a while; if it still fails, your account returns to the free plan.
• Features. We may add, change or remove features. If we stop offering Pro, we’ll refund the unused part of any prepaid period.

Acceptable use

Please use AshBid for your own personal, non-commercial research. Don’t:

• scrape, crawl, copy or bulk-download AshBid’s pages or data with bots, scripts or other automated tools (search engines following our robots.txt are fine), or use our data to build a competing service or dataset;
• resell, republish or redistribute our data, or use it to train commercial models without our written permission;
• get around paywalls, search limits, rate limits or other access controls, or share Pro access;
• probe, scan or test the security of AshBid, or interfere with it or overload it;
• create accounts automatically or in bulk, or impersonate anyone;
• use AshBid for anything unlawful, or to harass or harm anyone.

We may block access or close accounts that do any of these things.

Our content

The AshBid name, logo, design, software, text and our compilation of price data belong to us. You may view and use them for your own personal research, and quote or link to individual pages with credit to AshBid. If you send us feedback or ideas, we may use them without owing you anything.

Ads, sponsored content & affiliate links

AshBid may show ads and sponsored links, labeled “Sponsored” or “Ad”, and some links to retailers are affiliate links that may earn us a commission at no extra cost to you. Ads and commissions never change the auction prices we record. An ad isn’t an endorsement: offers, products and websites you reach through an ad are the advertiser’s responsibility.

Other websites and services

AshBid links to CigarBid, retailers and other sites, and uses services such as Stripe for payments. We don’t control them and aren’t responsible for their content, products, availability or privacy practices; their own terms apply when you use them.

No warranties

AshBid is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises that it will be accurate, complete, uninterrupted, secure or error-free, or fit for any particular purpose.

Limit of liability

To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special or consequential losses, or for lost money, savings, profits or data, arising from your use of AshBid, including bids or purchases made on other sites. Our total liability for any claim about AshBid is limited to the greater of what you paid us in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not all apply to you. You agree to cover our reasonable losses if a claim against us arises from your breaking these terms.

Ending your use

You can stop using AshBid and ask us to delete your account at any time (see the Privacy Policy). We may suspend or end your access if you break these terms or if we stop running AshBid. The sections on prices, our content, warranties, liability and governing law continue to apply after that.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute that can’t be settled informally will be handled by the state or federal courts located in Texas, unless the law where you live gives you the right to bring it locally. Please email us first; most problems can be sorted out quickly.

Changes to these terms

We may update these terms as AshBid changes. We’ll change the date at the top, and for significant changes we’ll let members know by email or with a notice on the site before they take effect. Continuing to use AshBid after that means you accept the new terms.
